Terms of Service

1. Acceptance of Terms

By accessing or using Caribbean RaceHub at caribbeanracehub.com or the Caribbean RaceHub mobile application (collectively, the “Platform”), operated by Robinson & Associates Tech Solutions LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to create an account on the Platform. By creating an account, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have the consent of a parent or legal guardian.

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and truthful information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to:

• Submit falsified race times: All times submitted must be genuine and supported by valid time slip photos. Fabricated, altered, or misleading times will be removed and may result in account suspension.
• Impersonate others:Do not create accounts or driver profiles pretending to be another person or use someone else’s vehicle or race data without authorization.
• Harass or abuse: Do not engage in harassment, bullying, threats, or abusive behavior toward other users, event organizers, or staff.
• Manipulate leaderboards: Do not attempt to game, manipulate, or exploit the leaderboard or ranking systems.
• Upload harmful content: Do not upload malicious files, offensive imagery, or content that violates any applicable law.
• Interfere with the Platform:Do not attempt to hack, reverse-engineer, or disrupt the Platform’s infrastructure.
• Spam or advertise: Do not use the Platform for unsolicited advertising or spam.

5. Content Ownership & License

5.1 Your Content

You retain ownership of all content you upload to the Platform, including photos, profile information, and race data (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Platform. This includes displaying your race times on leaderboards, your profile on driver pages, and your event participation publicly.

You may delete your User Content at any time through your account settings, which will terminate this license for that content (except where the content has already been shared or cached by third parties).

5.2 Our Content

The Platform, including its design, code, logos, and branding, is owned by Robinson & Associates Tech Solutions LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without written permission.

6. Event Registration

The Platform allows you to register for drag racing events organized by third-party event organizers. When you register for an event:

• Your registration information (name, vehicle, class, phone number) will be shared with the event organizer.
• Event rules, fees, and schedules are set by the organizer, not by us.
• We are not responsible for event cancellations, schedule changes, or refund policies.
• You are responsible for complying with all event rules and local regulations.

7. Disclaimers

7.1 Racing Activities

Drag racing is an inherently dangerous activity. The Platform is a leaderboard and event management tool only. We do not organize, sanction, supervise, or control any racing activities. We are not responsible for any injuries, property damage, or death that may occur during racing activities, whether or not those activities are associated with events listed on the Platform.

7.2 Accuracy of Data

Race times, rankings, and other data displayed on the Platform are submitted by users and event organizers. While we review submissions, we do not guarantee the accuracy, completeness, or validity of any race data. Times are displayed “as submitted” and should not be considered official results unless independently verified.

7.3 Platform Availability

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Robinson & Associates Tech Solutions LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

• Your use of or inability to use the Platform
• Any racing activities, whether or not related to events listed on the Platform
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Platform
• Any other matter related to the Platform

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Robinson & Associates Tech Solutions LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

10. Termination & Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

You may delete your account at any time by contacting us at legal@caribbeanracehub.com. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) shall continue in effect.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association, with arbitration conducted in Burlington County, New Jersey.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Burlington County, New Jersey.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
